Terms of Service

These Terms of Service (“Terms”) govern your access to and use of ChicGleam’s website, services, and purchases. By browsing, creating an account, or placing an order, you agree to these Terms. Please read them carefully.

Important eligibility notice

You must be at least 18 years old (or the age of majority in your jurisdiction) to create an account or make a purchase. Use of ChicGleam is also subject to local laws in your jurisdiction. If you do not agree, please discontinue use of the site.

For clarity, these definitions apply throughout these Terms.

“ChicGleam,” “we,” “us,” “our”
The ChicGleam brand and the company operating this website and related services.
“Site”
Our website, mobile experiences, and any pages where these Terms are posted.
“Services”
Browsing, purchasing, account features, customer support, and other features we provide through the Site.
“Products”
Fashion goods and related items offered for sale on the Site (e.g., apparel, accessories, limited drops).
“You,” “your”
Any individual or entity accessing or using the Services, including customers and account holders.
“User Content”
Content you submit to ChicGleam (such as reviews, photos, sizing notes, or messages). Example: a fit photo posted with a product review.

Account & Eligibility

By using the Services, you represent that you are legally able to enter into a binding agreement and that your use complies with applicable laws.

Account creation

You may need an account to access certain features. You agree to provide accurate information and keep it up to date.

  • Use a valid email address and truthful contact details.
  • Maintain the confidentiality of your password and device access.
  • Notify us promptly if you suspect unauthorized use of your account.

Prohibited use

You agree not to misuse the Services. For example, you must not:

  • Attempt to interfere with security, integrity, or performance of the Site.
  • Use automated scraping, bots, or harvesting without our written permission.
  • Use the Services for unlawful, deceptive, or abusive purposes.

Orders, Pricing & Payments

Pricing & availability

Product prices, descriptions, and availability may change at any time. We take care to display accurate information, but errors can occur (including pricing or inventory). If we discover an error, we may cancel affected orders and issue a refund.

Order acceptance

Your order is an offer to purchase. We may accept, decline, or limit orders at our discretion, including for suspected fraud, high return activity, reseller activity, or policy violations.

Currency, taxes & promotions

Prices are shown in the currency displayed at checkout. Taxes, duties, shipping, and other charges are added where applicable. Promotions may have additional terms (such as exclusions, minimum spend, or expiration). Promotional codes cannot be redeemed for cash and may be limited to one per order unless stated otherwise.

If a promotion is applied in error or is used in violation of its rules, we may cancel the order or adjust pricing accordingly.

Payment methods

We accept payment methods displayed at checkout. By providing payment information, you represent you are authorized to use it. We may use third-party payment processors; their terms and privacy practices may apply.

Shipping, Delivery & Returns

Shipping timelines

Estimated shipping and delivery dates are provided for convenience and are not guarantees. Delays may occur due to carrier issues, customs processing, weather, high-demand drops, or address verification.

Risk of loss

Risk of loss passes to you upon delivery to the carrier or as otherwise required by applicable law. If your package is marked delivered but you cannot locate it, please contact the carrier and our support team promptly.

Returns & exchanges

Return eligibility, timelines, condition requirements (unworn, tags attached), and exclusions (final sale, intimates, etc.) are described in our Returns Policy. We may refuse returns that do not meet policy requirements or show signs of wear.

Refund timing depends on inspection and payment method. Once approved, refunds typically post within 5–10 business days.

User Content & Reviews

If you submit User Content, you retain ownership of your content. However, you grant ChicGleam a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to use, display, reproduce, modify, and distribute your User Content in connection with the Services and ChicGleam marketing (for example, featuring a review on a product page).

Content standards

You agree not to upload or post content that is unlawful, harmful, or misleading. Prohibited content includes:

  • Hate speech, harassment, or threats.
  • Sexually explicit content or exploitation.
  • Infringing content, including unauthorized brand logos or copied product photography.
  • Spam, fake reviews, or undisclosed incentives.

Moderation & takedowns

We may remove or restrict User Content at any time for any reason, including suspected policy violations. If you believe content infringes your rights, contact us with sufficient details to investigate (such as URLs, proof of ownership, and your contact information).

Intellectual Property

The Services and all associated content are owned by ChicGleam or our licensors and are protected by intellectual property laws. This includes (without limitation) our brand name, logos, product photography, editorial styling, site design, text, graphics, and software.

Limited permission

We grant you a limited, revocable, non-transferable license to access and use the Services for personal, non-commercial use. You may not copy, reproduce, distribute, publicly display, reverse engineer, or create derivative works from the Services without our prior written permission.

Disclaimers & Limitation of Liability

Service provided “as is”

To the fullest extent permitted by law, the Services and Products are provided “as is” and “as available,” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Limitation of liability

To the fullest extent permitted by law, ChicGleam will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, arising out of or related to your use of the Services or Products.

Where liability cannot be excluded, ChicGleam’s total liability for any claim will be limited to the amount you paid to ChicGleam for the relevant purchase in the three (3) months preceding the event giving rise to the claim, or the minimum amount required by law—whichever is greater.

Some jurisdictions do not allow certain warranty disclaimers or liability limitations, so portions of the above may not apply to you.

Dispute Resolution

Informal resolution first

  1. Contact us with details of your concern (order number, dates, and what you’re requesting).
  2. We will attempt to resolve disputes in good faith within a reasonable timeframe.
  3. If we can’t resolve the issue, the dispute may proceed as described below.

Governing law & venue

These Terms are governed by the laws of the jurisdiction where ChicGleam is established, without regard to conflict of law principles. Any legal action must be brought in the courts located in that jurisdiction, unless applicable law provides otherwise.

Arbitration notice (if applicable): If ChicGleam adopts arbitration for certain disputes, we will provide clear additional terms, including any opt-out window and procedures. Unless expressly stated in a separate arbitration addendum, disputes will proceed in court as described above.

Nothing in these Terms prevents you from bringing a claim in small claims court if it qualifies.
